ROADS

The Board discussed the VDOT status report of June 21, 2010 staff briefing meeting.

The Board accepted report as information. General discussion regarding status of 2010 Rural Rustic projects and five (5) projects to be delayed.

STREET ADDITION

The Board discussed Community Development’s and VDOT’s recommendations to adopt resolution for acceptance of the following street into the Secondary Road system in accordance with VDOT request:

1. Northwood Subdivision, Section 7 (Middle River District) The Board authorized placing on the July 28, 2010 consent agenda for consideration.

REGIONAL STUDY – NARROWBANDING

The Board received a presentation by staff on regional narrowbanding initiative.

The Board accepted presentation as information.

OUTDOOR MUSICAL OR ENTERTAINMENT FESTIVAL

The Board discussed application as submitted by the Middle River Church of the Brethren for the “Singspiration” outdoor event to be held on September 11 at the Middle River Church of the Brethren church grounds (Middle River District).

The Board authorized placing on the July 28, 2010 consent agenda for consideration.

EMERGENCY SERVICES – ORDINANCE AMENDMENT

The Board discussed draft ordinance to amend Section 2-13 of the Augusta County Code to add a new volunteer fire department.

The Board authorized placing on the July 28, 2010 consent agenda for consideration to advertise for public hearing.

LICENSE TAX FOR WINERIES – ORDINANCE AMENDMENT

The Board discussed draft ordinance to amend Section 12-81 of the Augusta County Code to adjust the license tax for wineries based on a change in the State Code.

The Board authorized placing on the July 28, 2010 regular agenda for consideration to advertise for public hearing.

SHENANDOAH VALLEY SOCIAL SERVICES BUILDING

The Board discussed bids for the removal, disposal and installation of five rooftop HVAC units located at the Shenandoah Valley Social Services Building.

Funding Source: Buildings and Grounds Account #80000-8198 $74,330 The Board authorized placing on the July 28, 2010 regular agenda for consideration.

RIVERHEADS BULK WATER SYSTEM

The Board discussed purchase and installation of system per ACSA report.

Funding Source: Riverheads Infrastructure Account #80000-8015-54 $78,000 The Board authorized placing on the July 28, 2010 regular agenda for consideration.

PLANNED COMMERCE DISTRICT

The Board discussed the addition of a Planned Commerce District to the Zoning Ordinance and authorization for public hearing.

The Board authorized placing on the July 28, 2010 regular agenda for consideration to advertise for public hearing.

PLANNING COMMISSION ITEMS

1. DEERFIELD COMMUNITY CENTER LAND TRUSTEES – PUBLIC USE

OVERLAY

Discussed a request to add the Public Use Overlay Zoning Designation to approximately 4.9 acres owned by the Deerfield Community Center Land Trustees located on the west side of Marble Valley Road (Route 600) approximately 0.1 of a mile south of the intersection with Deerfield Valley Road (Route 629) in Deerfield (Pastures District). The Planning Commission recommends approval with proffers.

2. ZONING ORDINANCE AMENDMENT

Discussed an Ordinance amending the Zoning Ordinance of Augusta County by adding “Further processing of meat products for human consumption, provided that, on the premises, no livestock, fish or poultry are killed” to the list of Permitted Uses in the General Industrial zoning district. The Planning Commission recommends approval.

3. ZONING ORDINANCE AMENDMENT

Discussed an Ordinance amending the Zoning Ordinance of Augusta County by adding “Wood processing businesses” to the list of Special Use Permit uses in the General Business zoning district and establishing performance standards to be considered when approving such a permit. Standards include, but are not limited to, such provisions as, the minimum lot size for a wood processing business shall be 10 acres and all buildings, and structures and operations will be setback at least one hundred feet (100’) from all property lines. The Planning Commission recommends approval.

The Board authorized placing on the July 28, 2010 public hearing agenda for consideration.

MATTERS TO BE PRESENTED BY THE BOARD

The Board discussed the following:

Mr. Coleman: ISO rating reduction for Preston Yancey Volunteer Fire Department service Area. Rating decreased from 6 to 10 due to training records and staffing deficiencies. Could possibly double premiums.

It was the consensus of the Board to discuss further at their August 23rd Staff Briefing. Fire Chief Holloway is to provide a briefing; representatives from ISO and insurance agency possibly invited.

Mr. Beyeler: Sweet Dreams – Great success; however, hot! Excellent press coverage.

Ms. Sorrells:

1. Sweet Dreams – PDC Bike Committee handed out 220 helmets donated by Augusta Health. Recycling Committee distributed information. The new Riverheads Volunteer Fire Department manned a booth.

2. Middlebrook Library – Volunteer Lunch – Wednesday, July 28th, 12:00 to 2:00 p.m.

Mr. Shifflett: Middlebrook Library Volunteer Lunch – will be attending.

Mr. Pyles: Staggered terms – Citizen initiated petition drive has begun and circulated to Clerk of the Circuit Court. Asked permission from the Board to have the County Attorney review. It was the consensus of the Board to place on the July 28, 2010 regular agenda for consideration.

Chm. Garber:

1. Ordinance Changes – Complemented Board on recent ordinance changes, particularly, the setback requirements for floodplains. Has received positive feedback on Board action.

2. Extension Services Weather Stations – Because of staffing cuts, it has been proposed that weather stations historical data be entered and maintained by Kurt Michaels and his GIS Governor School class.

MATTERS TO BE PRESENTED BY STAFF

Staff discussed the following:

1. Use of County Vehicles – policy to be considered at the August 23, 2010 Staff Briefing.

2. Reform Commission Town Hall Meeting – Chairman Garber and Supervisor Beyeler attended on July 14th.

3. SPCA Agreement – executed agreement distributed to Board.

4. Greenville Sewer Grant Application – $1,861,440 Grant; $700,000 loan at 3.5%; $540,000 (90 x $6,000) = $3,102,400 ($49,820 year possible interest and principal payments to be offset by user rate supplement) 5. Drought update – Extension Service report distributed to Board.

6. National Law Enforcement Award: 1st place in State for Traffic Enforcement; 2nd place in Nationals 7. Tourism – Bike the Valley Grant – $700 donated from GART 8. Virginia Outdoors Foundation (VOF) application – staff provided letter of support for the Middlebrook-Brownsburg Corridor as a Special Project Area.

9. Staunton Pay Day Lending Resolution – distributed to Board.

10. VDOT Revenue Sharing – State to possibly split funds among requesting jurisdictions and could get 45% of requested funding.

11. Waiver Request – Buffer Yard Requirement waiver request to be considered at the July 28, 2010 regular agenda.

12. PILT – Fiscal Year 2010 PILT Summary distributed to Board.

13. Mills Creek Dam – Information distributed to Board.

14. Congressional Right-to-Work Bill – Resolution to be considered at the July 28, 2010 regular agenda.

15. WWRC Foundation Land Project – update given to Board.

16. Schools – State Sales Tax – $175,949 received in FY10.

17. Ordinances remaining – update given to Board.

18. CATS groundbreaking ceremony – August 11th, 10:00 a.m.

CLOSED SESSION

On motion of Mr. Shifflett, seconded by Ms. Sorrells, the Board went into closed session pursuant to:

(1) the personnel exemption under Virginia Code § 2.2-3711(A)(1) [discussion, consideration or interviews of (a) prospective candidates for employment, or (b) assignment, appointment, promotion, performance, demotion, salaries, disciplining or resignation of specific employees]:

A) Boards and Commissions (2) the real property exemption under Virginia Code § 2.2-3711(A)(3) [discussion of the acquisition for a public purpose, or disposition, of real property]:

A) Shenandoah Valley Detention Home On motion of Mr. Beyeler, seconded by Ms. Sorrells, the Board came out of closed Session.

Vote was as follows: Yeas: Sorrells, Garber, Beyeler, Shifflett, Pyles and Coleman Nays: None

Absent: Howdyshell
Motion carried.

The Chairman advised that each member is required to certify that to the best of their knowledge during the closed session only the following was discussed:

1. Public business matters lawfully exempted from statutory open meeting requirements, and 2. Only such public business matters identified in the motion to convene the executive session.

The Chairman asked if there is any Board member who cannot so certify.

Hearing none, the Chairman called upon the County Administrator/ Clerk of the Board to call the roll noting members of the Board who approve the certification shall answer AYE and those who cannot shall answer NAY.

Roll Call Vote was as follows:

AYE: Coleman, Garber, Sorrells, Shifflett, Pyles and Beyeler NAY: None

ABSENT: Howdyshell

The Chairman authorized the County Administrator/Clerk of the Board to record this certification in the minutes.

There being no other business to come before the Board, Mr. Beyeler moved, seconded by Ms. Sorrells, the Board adjourned subject to call of the Chairman.
